END-USER LICENSE AGREEMENT (EULA)

1. Introduction

This End-User License Agreement (EULA) is a legal agreement between you (the "User") and AJD Company, the owner of the interactive media design and graphic services provided through Magic Design.

2. Definitions

"AJD Company": Refers to the interactive media design and graphic services company, also known as "Arielle Johnson Design" Company.
"Magic Design": Refers to the website owned by AJD Company.
"Content": Refers to any text, graphics, images, software, and other materials provided through Magic Design.

3. License Grant

AJD Company grants the User a non-exclusive, revocable, non-transferable license to use Magic Design and its Content for the following purposes:

For personal use: Users may access and use Magic Design and its Content for personal, non-commercial purposes.
For commercial use: Users who purchase services from AJD Company are granted a license to use Magic Design and its Content for commercial purposes as specified in the purchased services.

This license is subject to the terms and conditions of this EULA. The User acknowledges that commercial use requires the purchase of specific services from AJD Company, and unauthorized commercial use is strictly prohibited.

4. Intellectual Property

All intellectual property rights in Magic Design and its Content are owned by AJD Company. The User agrees not to reproduce, distribute, or modify the Content without explicit permission or authorization from purchased licensed content.

5. User Responsibilities

Users are required to comply with all applicable laws, including those of the United States, and to refrain from engaging in any unauthorized or unlawful activities on Magic Design. Prohibited activities include, but are not limited to:

Violating any applicable federal, state, or local laws of the United States.
Infringing on intellectual property rights, including copyrights and trademarks, pertaining to the graphic design/interactive media content available on Magic Design.
Uploading, distributing, or using any content that violates graphic design industry standards, user experience standards, ethical guidelines, or any recognized professional practices.

6. Updates and Maintenance

AJD Company may provide updates to Magic Design. Users are encouraged to install updates to ensure optimal performance and security when available.

7. Disclaimers

Magic Design and its Content are provided "as is" without warranties of any kind. AJD Company disclaims all warranties, whether express or implied.

8. Termination

AJD Company reserves the right to terminate this license at any time for violation of the terms outlined in this EULA. Upon termination, the User must cease using Magic Design and destroy any copies of the Content.

9. User Support

10. Governing Law and Dispute Resolution

This EULA is governed by the laws of the Commonwealth of Massachusetts, USA. Any disputes arising out of or in connection with this agreement shall be resolved exclusively through state or federal courts located within the Commonwealth of Massachusetts.

11. Miscellaneous

Force Majeure: AJD Company is not liable for any failure or delay due to circumstances beyond its control.
Waiver: Failure to enforce any provision of this EULA does not constitute a waiver.
Severability: If any provision is found invalid, the remaining provisions shall remain in effect.
